FOCO MOTO ADVENTURES — RENTAL AGREEMENT & LIABILITY WAIVER This Rental Agreement and Liability Waiver ("Agreement") is entered into between FOCO Moto Adventures ("Company") and the undersigned renter ("Renter") as of the date of signature below. 1. RENTAL TERMS Renter agrees to rent the motorcycle(s) provided by FOCO Moto Adventures under the terms and conditions set forth in this Agreement. The rental period, vehicle(s), and associated fees are as specified at the time of booking. 2. RENTER ELIGIBILITY Renter represents and warrants that they: (a) hold a valid motorcycle endorsement or license issued by a U.S. state or equivalent jurisdiction; (b) are at least 21 years of age; (c) are in good physical and mental health and are not under the influence of alcohol, drugs, or any substance that impairs judgment or motor function; and (d) have sufficient experience operating a motorcycle of similar size and type. 3. ASSUMPTION OF RISK Renter acknowledges that motorcycle riding involves inherent risks, including but not limited to: collision with other vehicles or objects; loss of control; road hazards; adverse weather conditions; mechanical failure; and serious injury or death. Renter voluntarily assumes all such risks. 4. RELEASE OF LIABILITY To the fullest extent permitted by law, Renter hereby releases, waives, discharges, and covenants not to sue FOCO Moto Adventures, its owners, employees, agents, and representatives (collectively "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by Renter while using the rented motorcycle(s), whether caused by the negligence of the Released Parties or otherwise. 5. INDEMNIFICATION Renter agrees to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost they may incur due to Renter's use of the rented motorcycle(s), including reasonable attorneys' fees. 6. VEHICLE CONDITION & RETURN Renter agrees to: (a) inspect the motorcycle prior to departure and report any pre-existing damage; (b) operate the motorcycle in a safe and lawful manner; (c) return the motorcycle in the same condition as received, normal wear excepted; and (d) be financially responsible for any damage, loss, or theft occurring during the rental period. 7. DEPOSIT & DAMAGE A refundable security deposit of $500 per motorcycle is required at the time of rental. The deposit will be returned upon safe return of the vehicle(s) with no damage beyond normal wear. Renter is responsible for the full cost of repairs for any damage caused during the rental period. 8. PROHIBITED USE Renter agrees NOT to: (a) allow any other person to operate the rented motorcycle; (b) operate the motorcycle under the influence of alcohol or drugs; (c) use the motorcycle for racing, stunt riding, or any illegal activity; (d) take the motorcycle outside the State of Colorado without prior written consent from FOCO Moto Adventures. 9. INSURANCE Renter acknowledges that the rented motorcycle(s) may not be covered by Renter's personal auto or motorcycle insurance policy. Renter is solely responsible for obtaining any additional insurance coverage they deem necessary. 10. GOVERNING LAW This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado. Any disputes arising hereunder shall be resolved in Larimer County, Colorado. 11. SEVERABILITY If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect. 12. ENTIRE AGREEMENT This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior negotiations, representations, or agreements.
13. BREAKDOWN PROCEDURE & ROADSIDE POLICY In the event of a breakdown, mechanical issue, accident, or any situation that renders the motorcycle inoperable or unsafe to ride, Renter agrees to follow the procedure outlined below: STEP 1 — ENSURE SAFETY FIRST Renter must immediately move the motorcycle and themselves to a safe location away from traffic, hazards, or any dangerous conditions. Do NOT attempt repairs on a roadway, blind curve, or any unsafe location. If an injury has occurred requiring immediate medical attention, call 911 without delay. Renter acknowledges and accepts full financial responsibility for any ambulance transport, emergency medical services, or medical treatment required as a result of the rental. The safety and well-being of the Renter is the top priority. STEP 2 — CONTACT FOCO MOTO ADVENTURES Once safely located, Renter must contact FOCO Moto Adventures as soon as possible and provide: (a) current location and GPS coordinates if available; (b) the unit number displayed on the motorcycle; (c) a description of the breakdown issue or symptoms observed. FOCO Moto Adventures can be reached at (970) 599-1178 or ride@focomoto.com. STEP 3 — ASSESSMENT & ASSISTANCE FOCO Moto Adventures will assess the situation in consultation with the Renter and determine the appropriate course of action, which may include remote troubleshooting, dispatch of roadside assistance, or arrangement of towing services. Response time and available options will depend on location and circumstances. RENTER FINANCIAL RESPONSIBILITY FOR NON-MECHANICAL ISSUES Renter is solely responsible for all costs associated with non-mechanical breakdowns, including but not limited to: flat tires; running out of fuel; lost or locked keys; operator error; damage resulting from off-road excursions beyond normal trail use; and any situation caused by Renter's negligence or misuse of the motorcycle. REPLACEMENT & CREDIT POLICY In the event of a confirmed mechanical failure that is not attributable to Renter misuse or negligence, FOCO Moto Adventures will make reasonable efforts to provide a replacement motorcycle if one is available. If no replacement is available, a credit toward a future rental day may be offered at the sole discretion of FOCO Moto Adventures. Under no circumstances will a cash refund be issued for any breakdown — mechanical, rider-related, or otherwise — once the rental period has commenced. TOTAL LOSS In the event of a total loss of the motorcycle due to accident, theft, or any cause occurring during the rental period, Renter is responsible for the full replacement value of the motorcycle as determined by FOCO Moto Adventures. HELMET & PROTECTIVE GEAR Renter acknowledges that a helmet and appropriate protective gear are strongly recommended for all rides. FOCO Moto Adventures may provide a helmet as part of the rental package; however, Renter accepts full responsibility for ensuring that any helmet or gear used meets applicable safety standards and fits properly. FOCO Moto Adventures is not liable for any injury resulting from the use or non-use of a helmet or protective gear, whether provided by the Company or supplied by the Renter. Any damage to Company-provided gear during the rental period is the financial responsibility of the Renter. INREACH SATELLITE COMMUNICATOR If Renter elects to rent a Garmin inReach Satellite Communicator, Renter accepts full financial responsibility for the device for the duration of the rental period. In the event the inReach unit is damaged, lost, stolen, or destroyed during the rental period, Renter is responsible for the full replacement cost of the device as determined by FOCO Moto Adventures. Damage includes but is not limited to: water damage beyond the device's rated protection, physical impact damage, and loss of the device or its accessories. The inReach rental fee does not include insurance or damage waiver coverage of any kind. MILEAGE & GEOGRAPHIC BOUNDARIES The rented motorcycle is intended for use within the State of Colorado and on roads and trails reasonably accessible from Fort Collins, Colorado. Operation of the motorcycle outside the State of Colorado requires prior written consent from FOCO Moto Adventures. There is no daily mileage cap; however, Renter agrees to use the motorcycle for recreational riding consistent with the intended use of the rental and not for commercial transport, delivery, or extended multi-state touring without prior authorization. Excessive mileage or use beyond the agreed scope may result in additional charges at the sole discretion of FOCO Moto Adventures. PERMITTED ROAD USE & OFF-ROAD RESTRICTIONS Renter is authorized to operate the motorcycle on paved state and county roads and on maintained county gravel roads only. Renter is expressly prohibited from taking the motorcycle off county gravel roads onto unmaintained two-track, singletrack, technical trails, or any terrain that requires technical or difficult off-road riding skill. County gravel secondary roads are often remote and can be technically demanding; Renter assumes all responsibility for assessing whether a road is within the permitted scope before proceeding. Operation of the motorcycle on terrain beyond these boundaries — including but not limited to singletrack trails, rocky technical terrain, creek crossings, or any route not accessible by a maintained gravel road — constitutes a material breach of this Agreement and may result in full forfeiture of the security deposit, additional damage charges, and immediate termination of the rental without refund. WEATHER & TRAIL CONDITIONS Renter acknowledges that weather and trail conditions in Colorado can change rapidly and without warning, including but not limited to: sudden thunderstorms, hail, snow at elevation, flash flooding, high winds, and extreme temperature swings. FOCO Moto Adventures does not guarantee any particular weather or trail conditions during the rental period and is not responsible for any loss, injury, or inconvenience caused by adverse conditions. It is the Renter's sole responsibility to monitor forecasts, assess conditions before and during the ride, and make safe decisions accordingly. No refund or credit will be issued due to weather or trail conditions that prevent or shorten a ride. EQUIPMENT RETURN & LATE RETURN POLICY As with any rental — whether an automobile, recreational vehicle, lawn equipment, or otherwise — it is the sole responsibility of the Renter to return the motorcycle in satisfactory condition as defined by this Agreement, and at or before the end of the designated rental period. The motorcycle must be returned clean of excessive mud or debris, with no new damage beyond normal trail wear, and with all provided accessories (helmet, inReach, etc.) accounted for. Late returns will be automatically charged a full additional day's rental fee with no prior notice required. This charge will be deducted directly from the $500 refundable security deposit collected at the time of booking; any remaining deposit balance after the late fee is applied will be refunded to the original payment method. If the late fee exceeds the deposit balance, Renter authorizes FOCO Moto Adventures to charge the difference to the payment method on file. This policy exists to protect the availability of the motorcycle for subsequent customers who have reserved it. No exceptions will be made for late returns regardless of cause, including traffic, weather, mechanical issues, or personal circumstances. If Renter anticipates a late return, they must contact FOCO Moto Adventures immediately at (970) 599-1178. MEDIA RELEASE & MARKETING CONSENT By submitting this waiver, Renter grants FOCO Moto Adventures permission to use any photographs, videos, or other media submitted by Renter (including photos uploaded as part of this waiver process) or captured by FOCO Moto Adventures during the rental period for promotional, marketing, and educational purposes, including but not limited to use on the FOCO Moto Adventures website, social media accounts, print materials, and advertising. Renter's name, likeness, and general location may be included in such materials. No compensation will be provided for such use. Renter retains the right to request removal of specific media by contacting FOCO Moto Adventures at ride@focomoto.com. This consent does not apply to personally identifiable information such as driver's license numbers, dates of birth, or financial data, which are handled exclusively per our privacy practices.
